A Blacksburg mother faces involuntary manslaughter and child abuse/neglect charges in connection with the death of her child from last September.
A direct indictment unsealed this afternoon by Montgomery County reveals that a grand jury indicted Mary Nelson Parks for the crimes. Both are felony charges. The original indictment happened last Wednesday.
Montgomery County Commonwealth's Attorney Brad Finch will not prosecute the case. A judge appointed Wythe County Commonwealth's Attorney Gerald Mabe II as the special prosecutor for the case. It will be tried in Montgomery County.
The incident that spawned the indictment happened back on September 7, 2007. Police say Parks called 911, after finding her little boy not breathing in her car at Rainbow Riders childcare center in Blacksburg. Officers tell us Parks brought the child inside the daycare, trying to get help for him. The daycare staff tried to revive the toddler with CPR, but it was not enough.
Parks had enrolled her little boy at Rainbow Riders, but investigators told WSLS back in September that the boy did not attend that day.
According to the Medical Examiner, the child died of acute hyperthermia or heat stroke, temperatures in Blacksburg reached a high of 88 degrees that day.
If convicted, Parks faces up to 15 years in prison she's been released on a $5,000 bond. A trial date has been set for July 28th.
According to court records Parks is not allowed to leave the state without permission from the court and must follow any recommendations from the County's Department of Social Services.
