A convicted man facing the death penalty could soon learn his fate.

The jury that convicted William Morva recommended the death penalty over life in prison back in March. Morva is scheduled to be formally sentenced Monday morning.

Morva was found guilty of murder hospital security guard Derrick McFarland and Montgomery County Sheriff's Corporal Eric Sutphin.

If the Judge sentences Morva to death the decision will be automatically reviewed by the Virginia Supreme Court, that's a process that could take months.

Three things could happen:
-First, the Virginia Supreme Court may agree with the verdict and the sentence
-Second, they may agree with the guilty verdict but not the death sentence
-Third, they may disagree with everything

A clerk with the Virginia Supreme Court says that although it does happen occasionally, it is rare for the court to overturn a death sentence for capital murder.
