After her arrest Livia Crisan, 25, smiles for the camera at the New River Valley Regional Jail.
Her mug shot was taken moments after we sat down with her in her kitchen for an interview.
After we left she turned herself into the Galax Police Department.
Investigators had taken two warrants out for her arrest, because they say the nursing assistant took pornographic pictures of two Waddell Nursing and Rehab Residents without their permission.
However, when we asked why she was being investigated, she says she did nothing wrong.
“I admitted to taking one picture,” Crisan said. “It was a picture of an old man wearing a bandana and that was it.”
According to Crisan it was not pornographic in nature.
“He was fully clothed he was sitting his wheel chair and I think it was breakfast time,” she said.
Crisan says she was first questioned about a picture by Waddell staff.
She says she showed them the picture on her cell phone, it was deleted and she went back to work.
“Nothing was said and I was sent back to the floor. A couple weeks later I’m going to the police department.”
Now, she's facing charges and will soon have her day in court.
But before she faces a judge she wants the public to know her side.
“I want people to know that I did nothing wrong. I took a picture of an old man that I take care of,” Crisan explained.
A cell phone picture she says has landed her on the other side of the camera.

The Galax Police Department says its officers have made a second arrest in connection with pornographic pictures taken of patients at the Waddell Nursing and Rehabilitation Center.
Police Chief Rick Clark says Livia Dawn Crisan of Galax is charged with two counts of "knowingly and intentionally videotaping or photographing a nonconsenting person who was 18 years of age or older when such person was nude or in a state of undress without the person permission."
Chief Clark tells us that Crisan was arrested on Thursday. Officers previously arrested fellow former nursing home worker Sharon Walker, on the same charges.
