ROANOKE - Is it possible for Roanoke schools to sue the state and win? Lawyers are looking into it after the Roanoke City School Board gave the green light to do so.
"We feel like we are backed in a corner here," says School Board Vice-Chairman Jason Bingham. He says there aren't many other options. " We are sitting here not able to raise revenues and they are only asking us to find ways to cut which is only going to hurt the situation, but we don't know what else to do."
Bingham questions the constitutionality of the vast cuts in state aid. "The Constitution clearly states that it is the states responsibility to provide a high quality education and to maintain that education."
The School Board voted in favor of the motion five votes to two. Now Assistant City Attorney Tim Spencer is researching past similar cases and success rates to see how and where to go next.
"Lawyers are looking into it for us and what that really means, including time and money which we don't have any of those either," said Bingham.
