Tech sues Blacksburg real estate agency over alleged trademark violation

Virginia Tech is suing a Blacksburg real estate agency for an alleged trademark violation.

The university sued Hokie Real Estate Inc. in U.S. District Court in Roanoke.

The civil suit alleges the real estate agency is using the word "Hokie" without Tech's permission.

The suit basically asks a judge to make the real estate agency change its name.

John Wilburn owns Hokie Real Estate Inc. 

Wilburn declined to comment for this story, instead sending our interview request to his attorney, Blacksburg's James Creekmore.

Creekmore said the university never trademarked "Hokie," but does have the name "Hokies" under copyright licensing.

Tech spokesman Larry Hincker said, if the case goes to court, the university is prepared to show a judge plenty of case law stating there is no difference between trademark names such as "Hokie" or "Hokies."

Hokie Real Estate Inc. has a few weeks to issue its "response" to Tech's "complaint."
