The Eagle Rock volunteer firefighter involved in a deadly accident last Memorial Day will not be charged with a crime, according to family members of one of the victims.

Family members of Judi Martin tell 10 On Your Side Botetourt County commonwealth’s attorney Joel Branscom spoke with them by phone Thursday.

Branscom said there is not enough evidence to charge the volunteer, Lucas McCulloch, with a crime, according to Martin’s family.

Police say McCulloch was behind the wheel of a fire truck on May 26th when it crossed the center line, killing Martin and the driver of a pick-up truck in which she was a passenger, Russell Meadows.

Branscom said by phone late Thursday evening he would have more information on his decision Friday morning.
